Courts do not generally allow a child to choose where they want to live. Instead, an attorney appointed to represent the child’s interests is tasked with the responsibility of relaying the child’s wishes and position to the court. Even so, what the child says is not necessarily determinative of how the custody order will end up. I will say that, as the child gets older, absent circumstances that lead the court or the child’s attorney to believe the parent is being coached, the child’s wishes will carry increased weight.
